Wynne Corp., owner of Spanish Lakes Country Club Village Mobile Home Park, regulates lot rent as well as services, maintenance and appearance of lots and use of communal facilities.  Lease for lot must be obtained at Spanish Lakes Country Club Village sales office, as soon as Title to Home has been registered by Buyer.  It is acknowledged by Buyer that at least one person occupying 119 Calle De Lagos must be 55 years of age.

I.             DETERMINATION AND INSPECTION PERIOD

It is agreed by _____________________________ (“Buyer”) and Carole E. DuPre (“Seller”) that Buyer shall have all inspections of the mobile home (“Home”) performed as Buyer desires prior to the execution of Agreement and that Buyer shall be responsible for repair of damage or restoration of Home required as a result of any inspection.  It is understood that Seller shall be responsible to maintain the Home in the condition accepted by the Buyer until closing.  After closing, Buyer shall assume full responsibility of Home including the purchase of insurance.

II.      APPLIANCES, DRAPES, FIXTURES

Appliances to remain in the home include microwave, washer, dryer, refrigerator, range, oven, and toaster oven.  Window coverings, porch furniture and den furniture will also remain.  Additional items to remain in Home will be determined by Buyer and Seller before closing, and items agreed upon, if any, will be listed in Addendum 1 to this Agreement.

III.    EXECUTION OF PURCHASE AGREEMENT

Buyer acknowledges on signing this Agreement that he/she has inspected the Home.  It shall be Buyer’s further duty to re-inspect the premises on or close to closing date to determine if appliances and other items as specified by this Agreement are present in Home.  Seller makes no warranties or representations as to the quality of the appliances, flooring, drapes, and fixtures.

IV.      FINANCING

Upon execution of this Agreement by both parties, Buyer will give to Seller a Certified Bank Check in the amount of $_________________ (                                                          ).   In turn, Seller will sign over Title to Buyer.  PAYMENT FOR HOME SHALL BE IN FORM OF CERTIFIED BANK CHECK ONLY. 

V.                 TRANSFER OF TITLE

When Seller has received payment for purchase of Home, Seller will sign over Home’s Title to Buyer.   Buyer will be responsible for transfer of Title, registering Home, and paying sales tax at the appropriate agency(ies) in Fort Pierce, Florida.

VI.       CLOSING DATE

The date for closing, to be negotiated between Buyer and Seller, will be no less than Fifteen (15) days and no more than Twenty (20) days after Buyer and Seller have executed this Agreement, unless Buyer and Seller agree that Seller has more time to vacate premises.   The actual closing date will be stated in Addendum 1 to Agreement if such date is established after Agreement’s execution.

VII.     AS IS CONDITION

Buyer acknowledges Home is sold as is, and Seller bears no liability for Home’s contents and construction. This does not relieve Seller responsibility to disclose latent defects materially affecting the value or desirability of the Home.  Seller has received no notice from any governmental agency as to a currently uncorrected building or safety code violation.  Buyer expressly waives any claims against Seller or Seller’s agent, including the escrow agent/attorney for any unknown defects or other damage, which may exist or be discovered by Buyer.

Any and all records Seller has accumulated regarding maintenance of and renovations to Home during Seller’s ownership will be turned over to Buyer at the time Agreement is signed and Title is transferred to Buyer.
